I engaged Tiaki Family Law to provide independent legal advice and certify a separation agreement under the Property (Relationships) Act. The solicitor assigned to my matter produced a letter of advice containing serious errors. The central conclusion — that I was giving up over $676,000 — was wrong because she missed the entire section of the agreement that equalises the division through a 50/50 settlement mechanism. Remarkably, she acknowledged this mechanism herself later in the same letter, writing that "the agreement provides that everything will be divided 50/50," but then dismissed it without explanation. Her refusal to certify was based on this misreading. The letter also confused "conditional" with "unconditional" (opposite terms in conveyancing), identified the wrong properties as requiring simultaneous settlement, mischaracterised a shared debt as my sole responsibility, and stated that contracting-out agreements "can only be entered into during the relationship" — an incorrect statement of law under the very statute she was advising on. The letter also contained the wrong year, misspelled legal terms, and an unexplained calculation error. I am sharing this experience so that others can make an informed choice. If you engage this firm, I would recommend reading any letter of advice carefully against your agreement before acting on it to avoid factual errors. --- In response to the owner's comment: They claim they provide "clear, independent advice" and "uphold professional standards." I would invite any reader to consider: advice that states the direct opposite of what the agreement says is not clear. A review that misses an entire section of the document is not thorough. Eight factual errors across two documents from two lawyers is not a professional standard. Facts are facts. No amount of professional language can turn "must" into "no obligation," or an entire section into "no mechanism." Errors are errors, a carefully worded response does not make them disappear. I have lodged a formal complaint with the New Zealand Law Society Lawyers Complaints Service. The solicitor herself wrote that "the agreement provides that everything will be divided 50/50", and then concluded I was giving up $676,000. That is the quality of advice I received.
(Worse Lawyer Firm) Samantha was No Help, All year was dealt by a trainer Lawyer (Zoe) who has been with the firm not long nor knows a thing about law. just kept going round in circles waited a whole year to even step into court. Samantha and her team have now suggested I find a new lawyer after they claim I was upset with them. asking your lawyer for there suggestions on the next moves should be normal (Shouldn't it) I was never told or helped with what my rights are. Treated as if I'm already Guilty. Thanks for Nothing Tiaki No Help, wasted time.
