We had been in negotiation with IRD for nearly 2 years with fines and interest increasing all the time. We had left the negotiations to our accountant which proved to be fruitless. IRD had decided to instigate court action and a tax lawyer was our last option (should have been the first in hindsight) and we feel genuinely lucky to have found David Weaver and Tauranga Chambers. It is not an understatement to say he has saved our family a massive financial burden that would have been present for years to come. Use these guys – awesome to deal with and top tier lawyers.

After contacting Tauranga Chambers on the 8th of January 2024, I was directed to Rosie Gallagher, based in Wellington. Whom I believed was a lawyer. As a small business that recently received a charitable status, we were served papers for liquidating the company, and needed guidance on the best way to do this. We completed the paperwork required and implemented payroll suggestions as advised by Rosie, she stated that she could possibly have us set up as a trust and move the charitable status to this. I sent all our information and waited to hear. -On the 13th of Feb, Rosie asked to catch up on the 14th for a chat. I was unavailable on the 14 and advised the 15th. -On the 15th I emailed and said I was available. Nothing! -I emailed on the 20th of Feb, Rosie replied saying she was unavailable and said we would catch up on the 21st. I never heard from her. -I emailed on the 27th of Feb asking for an update, advising that our Fundraising Manager was unable to start our portfolio, as we needed to know if we could keep our company name. Until we knew, we couldn't use this new hugely experienced and successful Fundraising Manager, to help us get back on our feet. Again I heard nothing! - 5th of March I emailed again stating that we couldn't continue to actively look for more business, as we didn't know where we stand. And our fundraising manager had no choice but to move on. I got a reply, asking if she could call, the next day. AGAIN THIS DIDN'T HAPPEN! - 25th of March I emailed again, almost begging for an update on where we were at. I got a reply...... Stating "Without current compliance being demonstrated I cannot get an arrangement for you. I would go back to the lawyers and ask them to move the charitable status to a trust instead and run a new company through that. I would perhaps voluntarily liquidate ####, if IRD do however, they are highly unlikely to pursue any debt owed - you just aren't in the position to pay it."!!!!!! Firstly, I couldn't bring any money in because we needed to know if that was an option, so no, I didn't have the funds to meet the obligation. I was putting my own money, from personal loans from family, to pay the staff!!! Secondly, on going back to the original lawyers, stating what you told me, I was told that, it could not legally happen! Thirdly, Voluntary liquidation.... This would have been something I would have been happy to do, if that was told to me, without being told to try the other things first, and you had communicated this!!! In fact ANY communication would have been good! Liquidating a company isn't something the average person deals with. We put our faith in the professionals, to guide us. This has honestly been incredibly stressful. Not only for the fact that I am unable to continue doing the amazing work we do, but for the stress of trusting someone that let us down completely.
